The Trump administration announced a new proposed federal rule aimed at expanding access to fertility treatments and IVF benefits for American families. The proposal follows months of advocacy by the organization Tzedek, which has been actively involved in promoting broader fertility access policies at the federal level.

The new proposal, introduced jointly by the Departments of Labor, Health and Human Services, and Treasury, would create a new category of standalone fertility benefits similar to dental and vision coverage.

Under the plan, employers would be able to offer fertility treatment coverage separately from traditional health insurance plans, potentially making IVF and related treatments more accessible to many workers.

According to the proposal, fertility benefits could include diagnosis and treatment of infertility, medications, counseling, IVF procedures, and treatment for related reproductive health conditions.

The benefits would carry a lifetime cap of $120,000 per participant and beneficiaries, with future inflation adjustments beginning after 2028.

Supporters say the measure could be especially meaningful for families who currently cannot afford fertility treatments, which often cost tens of thousands of dollars and are not covered by many insurance plans.

Administration officials described the proposal as part of President Donald Trump’s broader effort to support family growth and increase access to fertility care across the United States.

The proposal also drew attention in the Orthodox Jewish community due to the involvement of Tzedek, an organization that has advocated extensively on infertility issues affecting Jewish families. Representatives of the organization participated in White House discussions surrounding the initiative, and Tzedek’s infertility policy advisor, Mrs. Weiss, attended the executive order signing ceremony earlier this year.

While the proposal must still undergo the federal rulemaking process before taking effect, many advocates are calling it a significant step toward helping more couples build Jewish families and reduce the financial and regulatory barriers surrounding fertility treatment. Public comments on the proposal are expected to remain open for 60 days after publication in the Federal Register.
