    New York Supreme Court Rules: 770 Belongs To The Rebbe

    On Erev Yud Shvat, the seemingly never-ending saga of the legal battles over the management of 770 has come to a close. News came that the Appellate Court of the Supreme Court of the State of New York reached a ruling. 

    The ruling states that Beis Chayeinu belongs to the Rebbe and to the Chassidim, and will be managed according to the Rebbe’s wish – the Gabbaim and according to the instruction of the Badaz of Crown Heights.

    The ruling brings an end to the long-running legal battle over the management of 770. The lawsuit was on behalf of Aguch and Merkos against the the gabbaim demanding they vacate the Shul and gain control of 770, contrary to what was done for the past 80+ years since the Rebbe Rayatz purchased it and as the Rebbe MH”M originally intended.

    As a refresher, As everyone knows, over the years, contrary rulings have been published, some of which the plaintiffs won and some of which the defendants won. In Iyar 5780, Justice Harriet L. Thompson of the Kings County Surrogate’s Court – who has since been dismissed from her position due to allegations of corruption – ruled that the authority over 770 Eastern Parkway belongs to the petitioners ‘Agudas Chasidei Chabad’.

    In its decision, the three-judge panel wrote that the Gabbaim should not have been sued, that the plaintiffs committed to keeping the shul open for religious services, and that the Courts cannot determine who the Gabbaim should be.

    The only part of the first court’s decision that was approved by the Court of Appeals is regarding the offices of the Shul on Kingston Avenue, which they are required to vacate and hand over to the plaintiffs.

    The ruling puts an end to the Chilul Hashem the case has brought, in which Aguch and Merkos refused the ruling of the Badatz of Crown Heights and instead turned to the secular court system to determine who should own and run 770. This also puts an end to the millions of dollars wasted in this case in legal fees that could have been used to expand 770.

    The Gabbaim stated they accept the verdict and now that the legal verdict is over they expect to work with Merkos and Aguch to expand 770. 

    They added, “Here is the place to thank the Gabbaim, led by Rabbi Zalman Lipsker and Rabbi Avraham Holzberg, who for decades were stood firm for  the fulfillment of the Rebbe’s wishes. Also thanks to the lawyer The legal team headed by Edward S. Rudofsky who represented the Gabbaim and the Mispallelim.
