    The seemingly never-ending saga of the legal battle over control of 770 Eastern Parkway continues.

    Two weeks ago, close to the auspicious day of Yud Shevat, a lawsuit was filed in a court in New York with the aim of implementing the ruling given about two years ago, in which the judge ruled that the rightful owners must vacate the shul.

    As a refresher, in Iyar 5780 Judge Harriet Thompson, who previously presided over the Landlord and Tenant Court in Kings County ruled that the “lawful owners” could decide not to allow gabbaim to run the synagogue, and that the mispallelim had no legal right to enter 770.

    After that ruling, the gabbaim and the mispallelim announced their intentions to appeal the ruling. Later they were informed that there was no need to hear the appeal, because according to the understanding of the Court of Appeals, there is no provision in the previous ruling for the eviction of the synagogue and the gabbaim, and therefore – no appeal is needed to leave the status quo intact.

    In a document issued by the court at the request of the “lawful owners”, the defendants are required to vacate the building within 60 days. The eviction order includes not only the gabbaim but also the mispallelim and all parties which make up “Congregation Lubavitch”.

    Upon issuance of the eviction order, the court gives the defendants 60 days to notify whether they intend to appeal the decision.

    The legal team representing the gabbaim intend to appeal this ruling and will continue to demand that the gabbaim and mispallelim maintain the right to occupy and manage the shul as the Rebbe MH”M originally intended.
