A dramatic appeal in Israel’s Supreme Court is scheduled for March the seventh. Amiram Ben Uliel convicted in the Duma fire bombing solely based on his own confession is appealing his sentence claiming it was obtained through illegal torture methods.
Some facts about this dramatic case.
Amiram has been held for the last six years in extreme conditions that include an almost complete cutoff from the outside world. The worst of terrorists that have been convicted of heinous crimes have not been kept in such extreme solitary confinement. Not even the infamous convicted Nazi war criminal John Demjanjuk who was tried in Israel was held under such conditions.
What comes to mind is the distinct possibility that the ISS (Shabak) is attempting to hide what really happened during the illegal interrogation torture sessions.
Some details about the case itself.
Amiram, according to the conviction affidavit, was said to have walked an unreasonable distance to torch the houses then to write two separate graffiti signs. The graffiti signs were each written differently.
One person could not have written both signs according to graphologists and neither of these match Amiram’s handwriting. Based only on his bizarre “reenactment” that Amiram was spoon fed by “Migael”, (code name for the ISS the man who perpetrated the illegal torture), the court convicted Amiram! There was no physical evidence linking him to the crime!
Another rather interesting detail in this case is the name of the leading attorney Avigdor Feldman.
In addition to Mr. Feldman’s litigation abilities, he is very far politically from the views of “ hilltop youths”. He nonetheless accepted the case and agreed to file the appeal because he is sure that there is no other evidence, except for the illegal confession, that ties Amiram to this crime. Despite his political stance he insists that the court throw out illegal confessions obtained through torture. It goes without saying that despite the severity of the crime attorney Feldman is convinced of the innocence of Amiram.
As an innocent man Amiram had no real idea what happened at the crime scene and refused to confess for the first 17 days until the intense torture began. It is important to note that Amiram was also refused his right to see a lawyer for 21 days, the absolute maximum that the courts can allow. This is why at day 17 the interrogators upped their methods, to ensure that by day 21 the case was basically “solved”.
After another interrogation of a minor (also tortured and tried to commit suicide!) who gave five different versions the “best” version was read to Amiram. After torture Amiram “provided” the version the interrogators wanted.
The miscarriage and travesty of justice in this case is clear.
No evidence links Amiram to the crime scene. No witnesses.
However, witnesses from the village of Duma claim that there were two preparators and a getaway car.
No car was found so investigators decided that Amiram alone “walked” to crime scene. No second offender, so the story was changed to Amiram alone.
An additional point to ponder. How realistic would it be for a Jewish young man to walk into an Arab village, torch a home and then come out of that village unscathed? In fact, how realistic is it for any Jewish person to enter an Arab village and leave unharmed?
We must not be silent over this outrage!
